Welcome to NitroStream. By using our macOS application, you agree to the following terms.

1. Eligibility

By using NitroStream, you represent and warrant that you are at least the age of majority in your jurisdiction of residence and are legally capable of entering into a binding agreement. If you are using the Service on behalf of an entity, you represent that you have the authority to bind such entity to these Terms.

2. License Grant and Restrictions

2.1 License Grant. Subject to your compliance with these Terms, NitroStream grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the NitroStream application on a single macOS device for your personal or professional broadcasting needs.

2.2 Restrictions. You agree not to, and will not permit others to:

• License, sell, rent, lease, assign, distribute, host, or otherwise commercially exploit the NitroStream application.
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Service.
• Use the Service for any illegal or unauthorized purpose.
• Circumvent any security features or usage limits of the Service.

3. User Accounts and Security

If the Service requires you to create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. NitroStream shall not be liable for any loss or damage arising from your failure to comply with this obligation.

4. User Content and Conduct

4.1 Responsibility for Broadcasts. NitroStream is a software tool used to facilitate live streaming. You are solely responsible for the content of your broadcasts. You represent and warrant that your use of the Service complies with the Terms of Service of any third-party platforms you use (e.g., Twitch, YouTube, Kick), all applicable local, state, national, and international laws and regulations, and all intellectual property rights of third parties.

4.2 Prohibited Content. You may not use the Service to stream content that is illegal, defamatory, infringing, or hateful. NitroStream reserves the right, but is not obligated, to monitor your use of the Service and to terminate your access if we believe your use violates these Terms.

4.3 Neutrality of Service and Third-Party Platforms. NitroStream is a software utility and does not function as a hosting provider or streaming platform. The Service is a tool that may be utilized for various types of broadcasting, which may include content intended for adult-oriented streaming platforms. NitroStream is not liable for the legality or regulation of content on third-party platforms.

• No Hosting. NitroStream does not host, operate, moderate, or manage any streaming platforms, including any adult-oriented websites.
• Platform Liability. Any legal responsibility, liability, or regulatory compliance regarding the legality, regulation, or nature of content on third-party platforms rests solely with the operators of those respective platforms.
• No Involvement in Legal Disputes. NitroStream shall not be held liable for, nor shall it be a party to, any legal actions, investigations, or disputes arising from the legality or regulation of content on third-party streaming platforms used in conjunction with the Service.

4.4 Chat and Communication Utilities. NitroStream provides certain chatbox and communication utilities (e.g., chat overlays) as technical tools to facilitate interaction.

• User-Configured Filtering. The Service may include features such as keyword filters for the chatbox. These are user-configured tools provided for the user's convenience; implementing or using these filters does not constitute active moderation or content control by NitroStream.
• No Moderation or Hosting. NitroStream does not host, moderate, or control the text, messages, or user-generated interactions that appear within these chat features. All messages processed through these utilities are generated by users on third-party platforms.
• User and Platform Responsibility. The responsibility for monitoring, moderating, and ensuring the legality and safety of all chat content resides entirely with the user and the hosting third-party platform. NitroStream is not liable for any content, messages, or interactions that occur through these chat utilities.

5. Intellectual Property

5.1 NitroStream Property. All rights, title, and interest in and to the Service (excluding user-generated content and third-party intellectual property), including the NitroStream software, application code, logos, and trademarks, are and will remain the exclusive property of NitroStream and its licensors.

5.2 Third-Party Intellectual Property. The Service integrates with various third-party platforms, services, and hardware. All rights, title, and interest in and to such third-party components—including but not limited to streaming platforms (e.g., Twitch, YouTube, Kick), chatbox providers, and premium plugin partners or integrations (e.g., Spotify, Lovense)—are and will remain the sole and exclusive property of their respective owners. Your use of any third-party integration or plugin is subject to the terms, conditions, and privacy policies of that respective third-party provider.

6. Subscriptions, Payments, and Refunds

6.1 Subscriptions and Fees. Certain features of NitroStream may require a paid subscription. All fees are expressed in [Insert Currency] and are exclusive of applicable taxes. Subscriptions automatically renew unless canceled via your account settings or your payment provider.

6.2 In-App Purchases. The Service may offer one-time, non-recurring in-app purchases for specific plugins or assets. These purchases are final.

6.3 Refunds and Statutory Rights.

• No Guarantee of Refund. Except as otherwise required by applicable law, all payments are non-refundable. NitroStream reserves the right, at its sole and absolute discretion, to evaluate and potentially issue a refund for a specific transaction.
• EU/UK Consumer Rights. For users located in the European Union, United Kingdom, or other jurisdictions with statutory "right of withdrawal" protections, you acknowledge that by accessing, downloading, or using the digital content of the Service, you expressly consent to begin the performance of the contract immediately and waive your statutory right of withdrawal once the download or access has commenced.
• No Precedent. The issuance of a refund for any single transaction does not create an obligation or expectation for future refunds.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NITROSTREAM DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NITROSTREAM, ITS EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR LOSS OF DATA, OR ANY OTHER LOSS ARISING FROM:

• Your use of or inability to use the Service.
• Any content streamed or produced using the Service.
• Any conduct or actions of third parties.
• Any unauthorized access to your data.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO NITROSTREAM FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless NitroStream and its employees from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, and privacy right.

10. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to the Service, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., the State of California, USA], without regard to its conflict of law provisions.

13. Data and Privacy

13.1 Data Processing. To provide and improve the Service, NitroStream collects and processes certain technical, usage, and diagnostic data (e.g., telemetry, error logs, and feature usage statistics). All data collection, storage, and processing are conducted in accordance with our Privacy Policy.

13.2 Privacy Policy Integration. Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how your information is handled.
